02. In the present case, the petitioner seeks bail in connection with NDPS Case No. 23 of 2025 (CIS No. 48 of 2025) arising out of Birpur P.S. Case No. 63 of 2025 registered for the alleged offences under Sections 8(c), 21(b), 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
03. As per prosecution case, recovery of 19 grams of brown sugar was made from the possession of the petitioner.
04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. From the FIR, it is evident that recovery of intermediate
Patna High Court CR. MISC. No.60652 of 2025(2) dt.08-09-2025 2/3 quantity of contraband has been made from the petitioner, which is much less than the commercial quantity. The petitioner is in custody since 21.02.2025 and charge-sheet has been submitted on 21.04.2025 without FSL report. The petitioner is having antecedent of four cases and he is on bail in all such cases
05. Learned APP for the State opposes the submission made on behalf of the petitioner. Learned APP submits that the earlier the petitioner was found involved in similar nature of case and appears to be a habitual offender.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the recovery of intermediate quantity of contraband from the petitioner and further considering the period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV, Supaul in connection with NDPS Case No. 23 of 2025 (CIS No. 48 of 2025) arising out of Birpur P.S. Case No. 63 of 2025, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:
(i) One of the bailors will be a close relative of

(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
