JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-12-2016 Both the above-said petitions arise out of Doriganj P.S. Case No. 81 of 2016 registered under Sections-307,379 and other minor sections of the Indian Penal Code and accordingly, both the above-said petitions are being heard and disposed of by this common order.
Patna High Court Cr.Misc. No.45967 of 2016 (4) dt.06-12-2016 2/3 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners and other accused are said to have assaulted the informant and his other family members on account of land dispute. It is specifically, stated in the fardbyan of the informant that the petitioner in Cr. Misc. No. 45967 of 2016 gave Axe blow, causing injury on the head of injured, Gopal Singh whereas; the petitioner in Cr. Misc. No. 47838 of 2016 gave Khanti blow, causing head injury to the informant. The injury reports of informant as well as one injured Raju Singh are available on the case diary and both the aforesaid injured are said to have sustained simple injury. So far as the injured Gopal Singh is concerned; neither his statement has been recorded nor his injury report was collected by the I.O.
Learned counsel, appearing for the informant submits that the aforesaid injured Gopal Singh sustained grievous injury on his head and his treatment is still going on at Durgapur, West Bengal but learned counsel, appearing for petitioners challenged the injury report, submitting that the injury report of injured Gopal Singh is an engineered document because the informant has specifically, stated in his statement that the treatment of the Gopal Singh was done at PMCH, Patna as well as Ruban Hospital, Patna.

No.45967 of 2016 (4) dt.06-12-2016 3/3 Moreover, there is case and counter case between the parties and some co-accused having more or less similar allegation, have already been granted privilege of anticipatory bail by a coordinate bench of this court vide order dated 19-10-2016 passed in Cr. Misc. No. 40324 of 2016.
Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of this fact that the investigation against the petitioners, has already been completed and the present occurrence took place on account of land dispute, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Doriganj P.S. Case No. 81 of 2016 to the satisfaction of learned Chief Judicial Magistrate/ACJMVII/concerned court, Saran at Chapra. (Hemant Kumar Srivastava, J) A.K.V./- U T
