The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307 and 379 of the Indian Penal Code and Section 27 of the Arms Act.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that while he was returning from his poultry farms carrying Rs.50,000/-, he was surrounded by the accused persons including the petitioner and thereafter, it is alleged that on orders of the petitioner, the accused persons assaulted him by iron rod, axe and this petitioner snatched chain from the neck of the uncle of the informant.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. No

Patna High Court CR. MISC. No.69107 of 2021(2) dt.26-07-2022 2/2 specific allegation has been alleged against him. He has been implicated merely by alleging that he was an order giver. It is next submitted that as far as snatching of chain is concerned, the same is ornamental in nature.

The learned Additional Public Prosecutor opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Tharthari P. S. Case No.124 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
