The writ application has been filed only for payment of balance GPF amount.
From the statements made in the counter affidavit, it is admitted that the application for withdrawal had been filed within the time and the authority slip for an amount of Rs. 2,85,031/- was sent to the Executive Engineer, Irrigation Division, Bhagalpur.
Patna High Court CWJC No.12550 of 2015 (2) dt.22-10-2016 2/2 Learned counsel for the petitioner submits that it is evident from the statements made in the counter affidavit that the entire deductions of the service period of the petitioner have not been taken into account and it is merely stated that as and when the same is received to the office of the respondents then necessary step will be taken and authority will be issued. This Court is in complete disagreement with the stand taken on behalf of the respondents. Once the petitioner has retired and the necessary details have been supplied and application for final withdrawal of GPF has been filed, then no such stand can be taken on their own leisure and pleasure that as and when the details of statements became available to them, then the same will be paid.
Let the District Provident Fund Officer, Bhagalpur ensure that all the details are collected by him within a period of two months from the date of receipt/production of a copy of this order and within a further period of 2 months thereafter the entire GPF dues of the petitioner are paid to him with statutory interest. With the above observations and directions, the writ application is disposed of.
