Mr. A.M.P. Mehta, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-12-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends her arrest in connection with Runisaidpur P.S. Case no. 134 of 2017, registered under Sections 363 and 366A of the Indian Penal Code. The accusation is of kidnapping of daughter of informant Ram Kumar Singh by Kanhai Kumar with help of his other family members and relative.

Learned counsel for the petitioner submits that, in fact, the petitioner is the mother of Kanahai Kumar, who is said to kidnap the daughter of the informant due to that reason the petitioner has also been implicated in this case. Further submission is that on 05.05.2017, the statement of daughter of informant was recorded under Section 164 of

Patna High Court Cr.Misc. No.53522 of 2018(3) dt.11-12-2018 2/2 Cr.P.C. in which she has stated about performing the marriage with Kanahai Kumar in the temple according to her sweet will and she also denied her kidnapping at that time, the age of victim was also assessed more than 18 years.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No. 134 of 2017, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
