JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Andharatharahi P.S. Case No. 62 of 2006, corresponding to G.R. No. 476 of 2006, registered for the offences punishable under Sections 147, 148, 149, 323, 324, 354, 307, 427, 504 of the Indian Penal Code.
As per the prosecution case, eleven accused persons including petitioner came variously armed with Lathi, Danda, Bhala etc. and started assaulting the family members of the informant and specific allegation against co-accused Azad is that he thrashed the daughter of the informant and pierced Barchi in her abdomen. In view of the above facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the learned Addl. Chief Judicial Magistrate, Jhanharpur, (Madhubani) in connection with Andharatharahi P.S. Case No. 62 of 2006, corresponding to G.R. No. 476 of 2006, subject to the condition as laid down under Section 438
(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned and he will co-operate in the investigation. (Vinod Kumar Sinha, J) T.Kr./- U T
