2. After some argument, learned counsel for the petitioners submits that he seeks permission to withdraw this application on behalf of petitioner no.1 (Shatrughan Dubey).
3. The instant application is dismissed as withdrawn with respect to Petitioner no. 1.
4. Thus, the instant application survives only with regard to petitioner nos. 2 to 4.
5. The petitioners apprehend their arrest in connection
Patna High Court CR. MISC. No.56676 of 2025(2) dt.29-08-2025 2/3 with Baniapur P.S. Case no.159 of 2025 registered under Sections 127(1), 115(2), 118(1), 109, 103(1) and 3(5) of the B.N.S, 2023.
6. The allegation in the F.I.R is that a dispute had taken place between the informant and the accused persons with regard to brick soling on account of which the informant's uncle Shatrughan Dubey indulged in abuse and assault and even pushed his mother who eventually died. It is further alleged that other accused persons also assaulted the informant.

Learned counsel for the petitioners submits that it would be evident from the F.I.R that specific allegations of assaulting the informant as also pushing the mother of the informant is upon accused Shatrughan Dubey. So far as these petitioners are concerned, there is general and omnibus allegation levelled against them. Both the parties are the agnates and the alleged occurrence has taken place due to land dispute. Post-mortem report of the deceased shows that cause of her death is on account of cardio respiratory failure and moreover, there is no allegation upon these petitioners in this regard. The petitioners undertake to co-operate in the case/trial.
8. The application for anticipatory bail is opposed by learned A.P.P. for the State.

In view of the entire facts and circumstances of the case and considering that they are female inmates of the house with no specific allegation, it is directed that the petitioners, namely, Nirmala Dubey @ Nirmala Devi, Preeti Dwivedee and Pinki Dwivedee having no criminal antecedent in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Baniapur P.S. Case no.159 of 2025 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
