JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and admittedly, the marriage of deceased had taken place with petitioner on 13.05.2012. It is also an admitted position that informant got information regarding the burn injuries of deceased on 26.05.2013 and after that he went there and found his sister in a private hospital. Furthermore, it is admitted case of the informant that deceased died at her matrimonial home on 03.06.2013 and her dead body was cremated. The present case was lodged on 01.07.2013.
The contention on behalf of the petitioner is that as a matter of fact, deceased was caught in fire while she was cooking
Patna High Court Cr.Misc. No.37621 of 2015 (3) dt.05-11-2015 2/2 meal and after the aforesaid incident, she was immediately taken to hospital by her in laws including the petitioner but she could not be saved and during course of her treatment, she died. It is further contended that dead body of the deceased was cremated in presence of informant but later on, informant lodged this case with some ulterior motive.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Bhawanipur P.S. Case No. 95 of 2013.
