JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B), 201/34 of the Indian Penal Code.
Petitioner happens to be elder brother in law of the deceased and according to prosecution case itself, the marriage of deceased had taken place in the year 2013 and after marriage she gave birth to a child. Moreover, it is alleged that deceased was subjected to cruelty and harassment due to non fulfilment of demand of one motorcycle but submission on behalf of the petitioner is that the parents in law of the deceased have already been granted privilege of bail whereas petitioner is in jail custody since long.
Patna High Court Cr.Misc. No.45518 of 2016 (2) dt.19-10-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Daraunda P.S. Case No. 272 of 2015.
