2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 363, 366(A) of the Indian Penal Code.
3. As per prosecution case, the petitioner along with others is alleged to have abducted the minor daughter of the informant, aged about 16 years for the purpose of solemnization of marriage, while the victim was going to market.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to dirty village politics. It is further submitted vide para 10 of the petition that the victim was recovered and her statement has been recorded u/s 164 of
Patna High Court CR. MISC. No.59148 of 2023(2) dt.04-09-2023 2/2 the Cr.P.C. wherein, she stated that she herself called the petitioner and went with him out of her own sweet will. No one abducted the victim according to her statement. Moreover, the petitioner is languishing in judicial custody since 21.6.2023. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Taraiya P.S. Case No. 169 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chhapra.
