JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 326, 307, 427, 120B/34 of the Indian Penal Code and Section 3⁄4 of the Explosive Substances Act.
The prosecution case is that informant, one Manjit Singh and two bodyguards got down in the Chapra Civil Court premises to depose in a triple murder case when explosives were hurled initially by co-accused Mahesh Singh and thereafter by co-accused Dhiraj Singh, as a result the informant and his bodyguard Jugeshwar Paswan received explosive injuries.
It is submitted by learned counsel for the petitioner that accusation is specific against co-accused Mahesh Singh and Dhiraj Singh when one of the F.I.R named co-accused Baleshwar Singh has been granted regular bail vide
Patna High Court Cr.Misc. No.40030 of 2015 (3) dt.30-10-2015 2/2 Cr. Misc. No. 49990 of 2014.
Keeping in view of the fact that others have been granted regular bail vide Cr. Misc. No. 49990 of 2014, let learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Chapra Town P.S. Case No. 277 of 2014, pending in the Court of learned Chief Judicial Magistrate, Saran at Chapra.
With the observations above, the application stands disposed of.
