No.438 of 2016 dt.06-09-2017 2/2 The question raised in this application for review with regard to applicability of the statutory provision and the provisions of payment of Gratuity Act is not a question which falls for consideration in a proceedings for review under Order 47 of the C.P.C. as laid down by the Supreme Court in the case of SASI (Dead) Through Legal Representatives Vs. Aravindakshan Nair and others-(2017) 4 SCC 692 which is a ground which has to be canvassed or challenged by the petitioner by taking the order impugned before an appropriate forum.
