JUSTICE BIRENDRA KUMAR ORAL ORDER 20-07-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 420 and 471/34 of the Indian Penal Code.
According to complaint petition, the petitioners brought the complainant on the pretext of providing her money from the government scheme for building washroom. However, they took the informant in the registry office and impersonating her as Guriya Khatoon got a registered sale deed in favour of Raj Kishore Singh.
Submission of the learned counsel for the petitioners
Patna High Court Cr.Misc. No.32136 of 2017 (2) dt.20-07-2017 2/2 is that photograph of the complainant on sale deed is there and after transfer of the land, she has come under pressure of some family members and lodged the present false case. Moreover, the allegation is yet to be established.
Let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria/successor Court in connection with Complaint Case No. 1268(C) of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
