JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-395, 427 & other minor sections of the Indian Penal Code and 27 of the Arms Act.

Petitioner is not named in the first information report but his name appeared in this case on the basis of CCTV footage. Submission on behalf of petitioner is that even if, it assumed to be true that the petitioner was seen in CCTV footage, then also, no specific overt act has been attributed against the petitioner and moreover, having more or less similar allegation, one co-accused Bindhyachal Kumar has already been granted privilege of bail by this court.

Accordingly, the petitioner named above, is

Patna High Court Cr.Misc. No.46187 of 2016 (2) dt.22-10-2016 2/2 directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Aurangabad (Muffasil) P.S. Case No. 137 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Aurangabad.
