The petitioner apprehends his arrest in connection with Khagaria (Mufassil) P.S. Case No. 274 of 2017 for the offence registered under Sections 302, 307, 120(B), 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution story, the informant alleged that in 2017, due to land dispute with Dharamveer Yadav and Subash Yadav, as the informant was returning, the accused persons armed variously after abusing them started assaulting and in the process, allegation against Subash Yadav, Ranveer Yadav and Mintu Yadav is/are of having caught hold of the hands of his brother after which accused Dharamveer Yadav

Patna High Court CR. MISC. No.60538 of 2022(2) dt.03-02-2023 2/2 opened fire on the chest, who subsequently was declared brought dead at Sadar Hospital, Khagaria.

Learned counsel for the petitioner submits that earlier final form was submitted so far as the petitioner is concerned, but later cognizance was taken by the learned Trial Court against him forcing him to take recourse to the anticipatory bail. In the said killing of 2017, the specific allegation against this petitioner is of having caught hold of hand of the brother of the informant facilitating Dharamveer Yadav to open fire on the chest causing death and in that backdrop, no case for anticipatory bail is made out, which is accordingly rejected.
