2. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 272, 273/34 of the IPC, section 30a of the Bihar Prohibition and Excise Act and sections 20 and 22 of the NDPS Act.

3. Prosecution case is that total 1.2 liters Nepali liquor and approx 19 grams Ganja have been recovered from the wooden shop.

4. Learned counsel appearing for the petitioner submits that no incriminating material has been recovered from the conscious possession of the petitioner. Petitioner's name has come in this case during course of investigation on the basis of confessional statement of co-accused. Petitioner is not owner of shop in question.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the facts of the case, this pre-arrest bail petition is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Madhubani in GR No. 36 of 2024, Rajnagar Police Station Case No. 123 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
