2. Petitioner seeks regular bail in connection with Excise P.S. Case No.900 of 2025 registered under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act.
3. There is total recovery of 1252.80 litres Indian made foreign liquor from the vehicles such as car, scooty and tractor at two different places. The petitioner along with other co-accused was arrested on chasing by police who was sitting in the car from which 146.880 litres of liquor was recovered. The other co-accused riding the scooty is alleged to have fled away leaving his scooty from which 8.640 litres of liquor was recovered.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing has been recovered from conscious possession of the petitioner. Petitioner is neither owner of the seized vehicles nor he has any concern with the seized liquor. There is no independent witness of the seizure list. Petitioner has one criminal antecedent of similar nature. Petitioner is in jail since 17.07.2025 and he undertakes to cooperate in the trial.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case as well as the submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise -II, Muzaffarpur in connection with Excise P.S. Case No.900 of 2025.
