The petitioner seeks bail in Majhaulia P.S.Case No.155 of 2015 registered for the offences punishable under Section 414 of the Indian Penal Code.

It is submitted that the police has prepared seizure list wrongly. The motorcycle was recovered from inside the house of the petitioner and not from the constructive possession of the petitioner. Petitioner has got no criminal antecedent. He is in jail custody since 13.06.2015. Petitioner has already remained in custody for more than two months.

Considering the facts aforesaid and the nature of the allegation made against the petitioner, the above named petitioner

Patna High Court Cr.Misc. No.38620 of 2015 (2) dt.28-08-2015 is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran in connection with the above noted case.
