JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-03-2022 Heard learned counsel for the petitioners and the State. Petitioners seek bail in Sadar P.S.Case No. 246 of 2021 registered for the offences punishable under Sections 25(1b)a,26,35 of the Arms Act and sections 394/402 of the IPC. On secret information a raid was conducted and some accused persons were apprehended with arms, while petitioners fled away from the place of recovery. Petitioners are in custody since 12.8.2021.

defence of the petitioners is that they were not apprehended on the spot rather their name has figured during course of investigation in confessional statement of co-accused. No incriminating material has been recovered from the

Considering the aforesaid facts and circumstances as well as period of detention of the petitioners, let both the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Sadar P.
