This application for grant of anticipatory bail arises out of Baheri P.S. Case No. 63 of 2016, disclosing offences under Sections 341,323,504,307,379,506 and 34 of the Indian Penal Code.

There is allegation against the petitioner of giving a blow with an axe on the head of the informant because of which he sustained injury.

Learned counsel for the petitioner has submitted that the injury has been found to be simple in nature. He has also submitted that the petitioner has no criminal antecedent except one being Baheri P. S. Case No. 57 of 2016 registered at the instance of the same informant.

Considering the above, this application is allowed. Let the petitioner above named in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Darbhanga in Baheri P. S. Case No. 63 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Court/police, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
