The petitioner is in custody in a case registered under Sections 376,511 of the Indian Penal Code.

The allegation against the petitioner is that when the informant had gone to ease in a field, the petitioner caught her and tried to outrage her modesty.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 3.8.2015. Charge sheet has not yet been filed in this case. The petitioner has got no criminal antecedent. There is no allegation of tampering with the evidence against the petitioner. The allegation of making attempt to commit

Patna High Court Cr.Misc. No.38438 of 2015 (3) dt.08-10-2015 2/2 rape is denied by the petitioner. It is further submitted that prior to the institution of the present case, the mother of the petitioner has filed a petition on 29.6.2014 against the informant and the present case is outburst of that case. It is further submitted on behalf of the petitioner that the petitioner may be released after competition of six months in custody from 3.8.2015. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released, after completion of six months in custody from 3.8.2015, on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional District & Sessions Judge-cumSpecial Judge, Bettiah, West Champaran, in Bettiah Town P.S.Case No. 340 of 2014.
