JUSTICE BIRENDRA KUMAR ORAL ORDER 06-11-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147/148/149/341/323/307/379/435/427/506 of the Indian Penal Code and Section 17 of the C.L.A. Act.
The offences alleged are against 50 to 60 unknown extremists.
Submission is that the case-diary would reveal that no one claims to have identified any member of extremist group present at the time of occurrence. Learned counsel for the State does not dispute the aforesaid fact.
Patna High Court Cr.Misc. No.59031 of 2018 (3) dt.06-11-2018 P2/ Considering the fact that there is no substantial material against the petitioner in this case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Mali Police Station Case No.74 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that bailors shall be resident of Indian territory having immovable property and the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
