1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Sinha Police Station Case No. 60 of 2025, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, while the police was on patrolling in the night, the informant got the information that two persons riding on Hero motorcycles were carrying liquor and going to deliver it in Saraiya village via Pashurampur school. The police intercepted the motorcyclist but they

Patna High Court CR. MISC. No.60754 of 2025(2) dt.08-10-2025 2/3 succeeded in fleeing away. From the motorcycle bearing Reg. No. BR03AG8101, 43.20 liters of foreign liquor was recovered.

4. Learned counsel for the petitioner submits that the petitioner is having no criminal antecedent and he has not committed any offence in the manner alleged. The motorcycle in question was borrowed by his friend for the purpose of some urgent work and the petitioner was not aware that illicit liquor was being carried in the said motorcycle.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the justification given by the petitioner and the fact that the petitioner is having no criminal antecedent and, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court-1st, Bhojpur at Ara, in connection with Sinha Police Station Case No. 60 of 2025, subject to the condition laid down under Section 438 (2) of the Code of Criminal
