====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 29-01-2025 Heard Mr. Dilip Kumar Singh, learned counsel appearing on behalf of the petitioners and Mr. Mohammed Arif, learned APP for the State.
2. The petitioners seek pre-arrest bail in connection with Bidupur P.S. Case No. 238 of 2024 registered for the
Patna High Court CR. MISC. No.63552 of 2024(4) dt.29-01-2025 2/3 offence punishable under Sections 304(B) and 201/34 of the Indian Penal Code.
3. As per the allegation made in the F.I.R., due to non fulfillment of demand of dowry, all the petitioners including the husband of the deceased committed murder and disposed of the dead body.
4. Learned counsel appearing on behalf of the petitioners submitted that the petitioners are innocent and they have committed no offence as alleged. He further submits that the deceased was critically ill. While she was being taken to the hospital, she died on the way. All the petitioners are co-villagers except petitioner no.8 who is the married nanad lives in a different village along with her husband. He further submitted that the husband of deceased voluntarily surrendered on 22.07.2024 and since then he is in custody. The petitioners have clean antecedent.
5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.
6. Considering the aforesaid facts and circumstances of the case, the petitioners, above named, are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the Court below within a period of four weeks
Patna High Court CR. MISC. No.63552 of 2024(4) dt.29-01-2025 3/3 from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 238 of 2024, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
7. The District Court is directed to verify the criminal antecedent of the petitioners and if it is found that the petitioners are involved in some other cases as what has been stated in Para-3 of the bail petition, this order will automatically lose its force.
8. The bail application stands disposed of.
