JUSTICE RAKESH KUMAR ORAL ORDER 16-12-2016 At the very outset, learned counsel for the petitioner makes a prayer for allowing him to make correction in paragraph1 of the petition. He submits that due to typographical mistake, instead of mentioning "N.D.P.S.Act", it has been typed as "IPC". The prayer is allowed.

The sole petitioner, who is in custody since 23.08.2016 in Majhaulia P.S. Case No.233 of 2016, corresponding to G.R. Case No.14 of 2016 registered for the offence under Sections 20 and 22 of the N.D.P.S.Act, has prayed for grant of

Patna High Court Cr.Misc. No.45819 of 2016 (2) dt.16-12-2016 2/2 bail.

It was submitted by learned counsel for the petitioner that the so called recovered Ganja is much lesser than the smaller quantity. He submits that total 237 gms of Ganja was recovered.

Considering much lesser than the smaller quantity of recovered Ganja, let the petitioner, namely, Niten Sil @ Nipen Sil be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand ) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, West Champaran, Bittiah in connection with Majhaulia P.S.
