This application, for grant of anticipatory bail, arises out of Sherghati Police Station Case No. 38 of 2015, disclosing offences under Sections 341, 324, 323, 326 and 307/34 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that there is general and omnibus allegation against the petitioner and no specific overt act is attributed to him. In fact, the petitioner has been working at Tata Finance Company at Jhansi and he was not present on the alleged date of occurrence and the petitioner has falsely been implicated in this case due to enmity. The petitioner has got no criminal antecedent. Hence, the petitioner
Patna High Court Cr.Misc. No.46717 of 2017 (2) dt.15-11-2017 deserves the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the petitioners, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya, in connection with Sherghati Police Station Case No. 38 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
