The petitioner apprehends his arrest in Jamui P.S. Case No. 115/2016, registered for the offences punishable under Sections 467, 468, 471, 420 and 120B of the Indian Penal Code. The prayer for anticipatory bail of the petitioner was earlier rejected vide order dated 05.08.2016 passed in Cr. Misc. 24086/2016, but the petitioner again filed this anticipatory bail petition on the ground that, similarly situated co-accused Pankaj Prasoon was granted anticipatory bail vide order dated 29.08.2016 passed in Cr. Misc. 28795/2016, but I am not persuaded to change my view, as the anticipatory bail petition of the petitioner was

Patna High Court Cr.Misc. No.47230 of 2016 (3) dt.11-01-2017 2/2 earlier rejected on merit, as the petitioner got appointment on the basis of fake educational certificate.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.

If the petitioner surrenders in the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail, learned court below shall consider the prayer for regular bail of the petitioner on its own merit and if possible, dispose of the bail petition on the same day.
