The petitioner apprehends his arrest in Kutumba P.S. Case No. 59 of 2014 registered for the offences punishable under Sections 379, 477 and 34 of the Indian Penal Code. The petitioner is not named in the FIR. The petitioner was executive engineer in irrigation department, Batane Division. The petitioner and other accused persons are alleged to have misplaced the official records but, it is submitted that it would appear from perusal of the enquiry report at page - 14 which is part of the FIR that the entire document was present in the office of the executive engineer till 26.04.2010. The petitioner was posted in Batane Division from 2000-07.

No.45768 of 2016 (2) dt.25-11-2016 2/2 Considering the facts that even after transfer of the petitioner the relevant records were present in the office of Batane Division, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Kutumba P.S. Case No. 59 of 2014, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
