JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-11-2025 Heard learned counsel appearing on behalf of the petitioner, learned APP appearing on behalf of the State and learned counsel appearing on behalf of the informant.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 316(2), 318(4), 351(2) and 352 of the B.N.S..
3. As per prosecution case, it is alleged that the petitioner took Rs. 15,50,000/- from the informant and thereafter, refused to return the same.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. As a matter of fact, the informant took Rs. 50,100/- from this petitioner and when the petitioner asked
Patna High Court CR. MISC. No.60494 of 2025(3) dt.11-11-2025 2/2 for his money, this false and concocted case has been lodged. Petitioner claims clean antecedents.
5. On the other hand, learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he took a loan from the informant and refused to return the same. Documents on record goes to show that there is a transfer of Rs. 7,00,000/- from the account of informant in favour of the petitioner.
6. Considering the facts and circumstances of the case and specific and direct nature of accusation, the prayer for grant of anticipatory bail to the petitioner is rejected. (Prabhat Kumar Singh, J) shashank/- U T
