The petitioner is in custody since 07.07.2019 in connection with Govindpur P.S. Case No. 63/2019 registered for the offence punishable under Sections 147/148/149/341/323/ 324/307/354(A)/379/452/504/506 of the Indian Penal Code. Learned counsel for the petitioner submits that though he is not named in the FIR, yet in the narration which involves the main occurrence, the petitioner is not said to have participated in the occurrence of marpit. It is further submitted that there is enmity between the parties as they are agnates and, therefore, he has been falsely implicated in the present case.
