2. The petitioner is seeking regular bail in connection with Janta Bazar P.S. Case No. 123 of 2024 for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. Allegedly, 33.760 liters of illicit foreign liquor was recovered behind the house of the petitioner.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that nothing was recovered from possession of the petitioner. He has also submitted that the petitioner is under custody since 04.07.2024.

5. On the other hand, the learned APP for the State

Patna High Court CR. MISC. No.67582 of 2024(2) dt.26-09-2024 2/2 has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned 3rd Exclusive Special Excise Court, Saran at Chapra in connection with Janta Bazar P.S. Case No. 123 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

7. Before release, the learned court below shall verify the criminal antecedent of the petitioner from all the police stations of the District and if he is found involved in any case other than the case as mentioned in para-3 of the bail petition, his bail bond shall not be accepted.
