The petitioner seeks bail in Buniyadganj P.S. Case No. 135 of 2021, registered for the offence punishable under Section 376 of the Indian Penal Code.

As per the FIR, this petitioner entered the house of informant/victim disrobed her and thereafter, committed rape upon her. It is further alleged that petitioner threatened the informant not to disclose the ordeal otherwise she would be killed.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. Petitioner is maternal father-in-law of informant and the doctor has not found any sign of recent sexual intercourse. Petitioner is in custody

Patna High Court CR. MISC. No.68734 of 2021(3) dt.21-04-2022 2/2 since 23.07.2021 having no criminal antecedent. Learned APP however, vehemently opposed the prayer for bail.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
