The petitioner is in custody since 21.06.2019 in connection with Sitamarhi P.S. Case No. 323/2019 registered for the offence punishable under Sections 419/420/338/269/270/ 467/468/188 and 120(B) of the Indian Penal Code. Learned counsel for the petitioner submits that whatever be the nature of allegations as against other persons including the doctor of the concerned hospital, the petitioner is merely a watchman in the hospital and has nothing to do with any surgical operations conducted at the said hospital or in any treatment which is being undergone by in-house patients. Learned counsel for the petitioner further submits that the petitioner is not named in the F.I.R. and his name has surfaced only in the statement of one Jyoti Kumari in her confession

Considering the aforementioned facts and circumstances and that the petitioner has nothing to do with the running of the hospital and is merely a watchman and also further that he has no criminal antecedent, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi P.S. Case No. 323/2019.
