The Additional District Judge-1st, Patna City has only allowed the intervention application filed by respondent no.1 on the ground that he has also filed a probate case on the basis of Will said to have been executed by one Bulkaniya Devi. The present probate case has been filed by the petitioner on the basis of Will said to have been executed by Bulkania Devi. Therefore, it is admitted that two probate cases are pending for decision an as such it is necessary that respondent no.1 should be added in the preset probate case. Therefore, the court below has rightly allowed
Patna High Court CWJC No.13030 of 2015 (2) dt.12-05-2016 2/2 the intervention application. As such I do not find any reason to interfere with the impugned order. Accordingly, this writ application is dismissed.
