JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section-414 of the Indian Penal Code.
The petitioner is languishing in jail custody since 1907-2016 on the accusation that one stolen motorcycle was recovered from his house but submission on behalf of petitioner is that even after completion of investigation, police could not succeed to establish that the aforesaid motorcycle was stolen property.
No doubt, petitioner carries criminal antecedent of three cases but considering the above-said submissions as well as this aspect of the matter that the investigation against the petitioner has already been completed, let the petitioner named
Patna High Court Cr.Misc. No.45952 of 2016 (2) dt.21-10-2016 2/2 above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Dulhin Bazar P.S. Case No. 108 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur.
