The petitioner seeks bail in Sahpur P.S.Case No.118 of 2005 registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.
The petitioner alleged to have assaulted the informant with Tangi on his chest when father of the informant came to save Umashankar Tiwary fired at his chest and the father of the informant died. Vijay Shankar Tiwary fired at Shri Bhagwan Tiwari, the nephew of the informant. Om Prakash Tiwary received one injury 3 " x 1⁄2 "x 1⁄2" by sharp weapon. The petitioner is the assailant of Om Prakash Tiwary and he is in jail custody since 10.07.2013. The petitioner has already remained in jail for more than two years. Petitioner is not the assailant of the father

Considering the facts aforesaid and the nature of the allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 8th Adhoc Additional District & Sessions Judge, Ara in connection with Sessions Trial No.6 of 2014 arising out of Sahpur P.S.Case No.118 of 2005.
