====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 21-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offences punishable under Sections 498A/34, 307, 326, 504, 304B of the Indian Penal Code read with Sections 3 and 4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 11.08.2021, is a person with clean antecedent and charge-sheet has been submitted. The informant (Puja Devi deceased) alleges that she was married to Upendra Rai about one and half year back and was blessed with a girl child. Further, soon after marriage, she was subjected to cruelty for fulfilling the demand of dowry. Further, on 01.12.2015, when she was going to cook meal, her mother-in-law

Patna High Court CR. MISC. No.68491 of 2021(2) dt.21-04-2022 2/2 and sister-in-law started quarreling with her and she complained about the same to her husband, he also abused and assaulted her. It is further alleged that thereafter all the accused persons sprinkled Kerosene oil and set her ablaze on which she screamed and thus nearby people came and she was admitted to PMCH, Patna. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. The husband of the deceased is in custody and the petitioner is cousin father-in-law of the deceased.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 11.08.2021, is a person with clean antecedent and charge-sheet has been submitted and the husband of the deceased is in custody, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Maner P.S. Case No. 533 of 2015.
