The petitioner apprehends his arrest in Sirdalla P.S. case No.2 of 2016 under Section 307 and other Sections of the Indian Penal Code.
The informant named four persons in the FIR and alleged that they all came and began to abuse the informant. The petitioner is alleged to have assaulted Deo Nath Yadav, son of the informant, with axe on his head.
It is submitted that the occurrence took place due to irrigation of land. One lacerated wound is found on the person of injured and the same is simple in nature caused by hard and blunt substance.
Considering the facts aforesaid and the fact that the
Patna High Court Cr.Misc. No.45977 of 2016 (2) dt.25-11-2016 2/2 occurrence took place on account of irrigation of land and the injured got simple injury, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in Sirdalla P.S. Case No. 02 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
