Petitioner apprehends his arrest in Tekari P.S. Case No. 251 of 2014 registered under sections 498A, 341 and 323 of the Indian Penal Code and 3⁄4 of the Dowry prohibition Act. Petitioner is the husband. Wife of the petitioner made allegation of demand of dowry and torture. Petitioner is ready to keep his wife. It is submitted that due to some misunderstanding the case is lodged.
Considering the facts aforesaid petitioner is directed to surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order and thereafter the court below shall issue notice to the
Patna High Court Cr.Misc. No.41368 of 2014 (2) dt.01-04-2015 2/2 informant and enlarge the above named petitioner on provisional bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in Tekari P.S. Case No. 251 of 2014 and on appearance of the informant the court below shall try to resolve the dispute between the husband and wife. If the dispute is resolved, the provisional bail granted to the petitioner shall be confirmed by the court below and if the dispute is not resolved the court below shall pass order in accordance with law on the provisional bail of the petitioner.
