The petitioner is in custody in a case registered under Sections 498(A) and 307 of the Indian Penal Code and later on Section 304(B) of the Indian Penal Code is added. The allegation against the petitioner is of setting fire the daughter of the informant.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. He is in custody since 20.06.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. From perusal of para 41 of the case diary it appears that the deceased has sustained burn injury while she was cooking
Patna High Court Cr.Misc. No.38951 of 2015 (3) dt.13-10-2015 2/2 food and she was taken to hospital for treatment where in course of treatment she succumbed to the injury.
On behalf of the State, it has been submitted that the petitioner is named in the FIR and is the husband of the deceased and charge sheet has been submitted against the petitioner under Section 306 of the Indian Penal Code.
Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Bihar Sharif in Noorsarai P.S.Case No. 137 of 2015.
