The petitioner apprehends arrest in connection with Complaint Case No. 285 of 2016, Tr. No. 343 of 2017 registered under Sections 420, 467 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that petitioner had given Rs. 15,00,000/- to the complainant for doing M.D. from Faridabad Medical College. But when admission was not done, petitioner asked he complainant to return the money. In this regard petitioner also filed an Informatory Petition (Annexure-2) before the Chief Judicial
Patna High Court Cr.Misc. No.33453 of 2017 (2) dt.20-07-2017 Magistrate, Gopalganj. In retaliation and to avoid return of money to the petitioner, the present false case has been lodged. Petitioner also filed Complaint Case No. 20399 of 2016 (Annexure-3) against the complainant of the present case.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate XIV, Gopalganj in connection with Complaint Case No. 285 of 2016, Tr. No. 343 of 2017 subject to the condition as laid down under Section 438(2) of the Cr. P.C.
