JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Araria (Bairgachhi) P.S. Case No. 343 of 2019, registered for the offences punishable under Sections 341, 323, 324, 307, 379, 506, 504/34 of the Indian Penal Code. As per prosecution case allegation is that co-accused Md. Juber armed with sword assaulted on the head of the husband of the informant causing head injury and there is allegation against petitioner No. 2 to 4 that they assaulted the informant.

Patna High Court CR. MISC. No.55141 of 2019(2) dt.02-09-2019 2/2 Submission of the learned counsel for the petitioners is that injuries sustained by the injured are simple in nature. Heard learned A.P.P. also.

In view of the above facts and circumstances, let petitioners, above named in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Araria ( Bairgachhi) P.S. Case No. 343 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
