ANJANA MISHRA ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 406/420 of the Indian Penal Code.

Learned counsel for the petitioner submits that though at the time of inspection, the required documents could not be produced by the managers of the petitioners, yet they had deposited the necessary fee for issuance of the licence, certificate being a No Objection Certificate from the Pollution Department. He, thus, submits that there was no violation of the Rule 26K of the Bihar Minor and Mineral Concession Rules 1972 and Section 40 of the said Act so as to occasion any prosecution against the present petitioners.

Patna High Court Cr.Misc. No.35558 of 2017 (2) dt.10-08-2017 P2/2 Having considered the documents which have been filed along with the present bail application and that the petitioners are having clean antecedent, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Mali P.S. Case No. 32/2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
