No.8419 of 1999 was disposed of issuing a direction to the Director, Secondary Education to consider the case of the petitioner and take a decision. It was also indicated in the order that the Court has not expressed any opinion on the merits of the claim and it has only remitted the matter back.
Respondents, represented by Shri Sushant Praveer, points out that even though a show cause has been filed in the
Patna High Court MJC No.3997 of 2014 (3) dt.21-07-2017 2/2 matter and Annexure A to the show cause is the order passed by the Director, Secondary Education on 8th of December, 2014 considering and rejecting the claim of the petitioner, the computer generated report indicates that no show cause is available on record. The matter is listed for the first time today after it was filed on 15.10.2014. None is appearing for the petitioner and learned counsel for the respondent produces before me a copy of the show cause along with the order Annexure A dated 8th of December, 2014 passed by the Director, Secondary Education, Bihar deciding the claim of the petitioner. That being so, in the facts and circumstances of the case, no further action is required to be taken in the matter.
A copy of the order Annexure-A be supplied to the petitioner and the petitioner is granted liberty to challenge the same in case his grievance still subsists, in accordance with law. Learned counsel for the State is requested to bring on record Annexure A during the course of the day. With the aforesaid, this application stands disposed of.
