The petitioners apprehend their arrest in Falkaha (Pothia) P.S. Case No. 23 of 2016 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.
Uday Mandal, the informant, named ten persons including the petitioners Ganga Mandal and Suresh Mandal and alleged that Gujay Mandal assaulted the informant with Garasa, when his wife Kanchan Devi came to save the accused persons assaulted her. When Meena Devi came to save, Mantu Mandal, Ganga Mandal, Mahesh Mandal and Akhilesh Mandal assaulted her and when Suman Kumar came to save, Chandan Mandal and
Patna High Court Cr.Misc. No.48941 of 2017 (2) dt.17-10-2017 Sadanand Mandal are alleged to have assaulted Suman Kumar. Learned counsel for the petitioners submits that there is a counter version. Suman Kumar got simple injuries. Meena Devi also got simple injuries. Similarly situated co-accused Mantu Mandal, Victor Mandal and Sadanand Mandal have already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 13.07.2017 passed in Cr. Misc. No. 31138 of 2017. Considering the facts aforesaid, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, V, Katihar in Falkaha (Pothia) P.S. Case No. 23 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
