The petitioners seek bail in Industrial P.S. Case No. 120 of 2021, registered for the offence punishable punishable under Sections 420, 467, 468 of the Indian Penal Code and sections 30(a), 36 and 41(I) of the Bihar Prohibition and Excise Act, 2016.
7366.320 litres of foreign liquor has been recovered
Patna High Court CR. MISC. No.69184 of 2021(2) dt.22-12-2021 2/2 while being unloaded from a truck and loaded the same on a pick-up van. Petitioners are alleged to have fled away from the place of recovery.
It is submitted that no recovery has been made from conscious possession of these petitioners. Petitioners are neither driver nor owner of vehicles in question and they are simply labourer and have got no concern with the seized liquor. Petitioners are in custody since 22.07.2021 having no criminal antecedent, as stated in para 3 of the petition. Investigation is complete.
Considering the period of custody coupled with the fact that petitioners bear clean antecedent, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II-cum-Special Judge, Vaishali at Hajipur in connection with Industrial P.S. Case No. 120 of 2021.
