ANJANA MISHRA ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Sherghati P.S. Case No. 27 of 2017 for the offences registered under Sections 414, 420, 467, 468, 471, 120(B) and 384 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is the owner of the truck bearing Truck No. JH 0950904 and the allegation that the truck was carrying stolen coal is wholly misconceived. It is further submitted that the coal found on the truck was in fact genuine and has all valid documents and on the basis of the same, the State of Jharkhand has now released the truck in favour of the petitioner.

No.27357 of 2017 (2) dt.07-07-2017 Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Sherghati at Gaya in connection with Sherghati P.S. Case No. 27 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
