Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Jokihat (Mahalgaon) P.S. Case No. 379 of 2021, lodged under Sections 302/201/120(B)/34 of the Indian Penal Code. As per prosecution case, there are 7 accused persons against whom the present case has been filed but the name of petitioner is not there in the F.I.R.

Learned counsel for the petitioner submits that petitioner is not named accused. He further submits that antecedent of petitioner is clean and he is in custody since 25.08.2022. He also submits that the named accused persons has already been granted bail by the Co-ordinate Bench of this

Patna High Court CR. MISC. No.56895 of 2022(2) dt.24-02-2023 2/2 Court which is annexed as Annexure-2 series. Learned counsel for the petitioner further submits that name of petitioner has figured in this case only and only due to the reason that with a view to dissolve the dispute between the informant and accused person, this petitioner had played the role of mediator. Learned counsel for the State opposes the prayer for bail and submits that as per order sheet, his role is there in concealing the dead body.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jokihat (Mahalgaon) P.S. Case No. 379 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
