The petitioners are apprehending their arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Section 420 of the Indian Penal Code.
The prosecution case is that the petitioner no. 1 namely Sulakshna Devi sold the land of the complainant in favour of petitioner nos. 2 and 3.
It is submitted by the learned counsel for the petitioners that the original land holder was Laxmi
Patna High Court Cr.Misc. No.38819 of 2015 (2) dt.30-09-2015 Shankar Prasad, who sold the land in question to Nirmala Devi in 2003 and from Nirmala Devi the husband of petitioner no.1 purchased the land in question in 2004 and Jamabandi was running in his name. The complainant has also filed Title Suit No. 06 of 2014 with regard to the same cause of action. Considering the accusation in the background of title dispute between the parties and petitioners being ladies, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Khagaria in connection with Complaint Case No. 1446C of 2013, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
