The petitioner apprehends his arrest in Hajipur Sadar P.S. case No. 126 of 2016 under Section 307/34 of the Indian Penal Code and under Section 27 of the Arms Act. The informant alleged that he was watching cultural Programme but in the meantime Raju Rai, Pankaj Choudhary, Umesh Rai, the petitioner, and Niraj Paswan came and made indiscriminate firing at the informant. The informant got one fire arm injury on his back.
The learned counsel for the petitioner submits that four persons are alleged to have fired but the informant received only one fire arm injury. Raju Rai had inimical term with the
Patna High Court Cr.Misc. No.45767 of 2016 (2) dt.24-11-2016 2/2 informant. The petitioner has got no manner of concern with Raju Rai or the informant.
It appears that informant made allegation that all the four accused persons, including the petitioner, made indiscriminate firing and fortunately the informant got only one fire arm injury.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
